Terms of Use (EULA)

1. Your Agreement to These Terms

These Terms of Use (the “Terms”) form a binding legal agreement between you (the "User") and HomieLab ("HomieLab", "we", "our", or "us").

These Terms govern your use of all of our mobile applications (the "Apps"), our website https://homielab.com, and all related services (collectively, our "Services").

These Terms also constitute an End User License Agreement (EULA), which grants you a license to use our Apps.

By downloading, installing, or using our Services, you agree to accept and be legally bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

2. Relationship with App Stores (Apple & Google)

This agreement is between you and HomieLab only, and not with the app store provider (e.g., Apple, Inc. or Google, Inc., hereafter "App Store Providers").

  • Responsibility: HomieLab, not the App Store Providers, is solely responsible for the Apps and their content.
  • App Store Terms: Your use of our Apps must also comply with the terms of service of the App Store Provider from which you downloaded the App (e.g., the Apple App Store Terms of Service or Google Play Terms of Service).
  • Support & Claims: The App Store Providers have no obligation to provide any maintenance, support, or warranty for the Apps. HomieLab, and not the App Store Providers, is responsible for addressing any claims you or a third party may have relating to the App, including product liability, legal compliance, and intellectual property infringement.

3. License to Use Our Apps

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to:

  1. Download and install one copy of the App on a device that you personally own or control.
  2. Use the App for your own personal, non-commercial purposes.

4. License Restrictions (Acceptable Use)

You agree that you will not, under any circumstances:

  • Copy, modify, or create derivative works of the App.
  • Reverse engineer, decompile, disassemble, or attempt to discover the source code of the App.
  • Sell, rent, lease, sublicense, or otherwise transfer any rights to the App.
  • Share any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
  • Engage in any illegal activity or encourage others to do so.
  • Use any "cheats," "bots," "hacks," or other unauthorized software to interfere with the Services.
  • Infringe on our intellectual property rights or the rights of any third party.
  • Transmit any viruses, worms, malware, or other malicious code.
  • Use our Services for any commercial purpose without our prior written consent.

We reserve the right to investigate and, in our sole discretion, terminate or suspend your access to the Services without notice for any violation of these rules.

5. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and share your personal information. By using our Services, you also agree to our Privacy Policy.

6. Eligibility and Age Requirements

You must be at least 13 years old to use our Services.

If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you may only use our Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

7. Subscriptions, In-App Purchases, and Free Trials

Our Apps may offer In-App Purchases ("IAPs") and/or auto-renewable subscriptions.

  • Billing and Payment: All payments are processed through the respective App Store Provider (Apple or Google) from which you downloaded the app. You are subject to their payment terms. We do not process or store your payment card details.
  • Auto-Renewable Subscriptions: If you purchase an auto-renewable subscription, it will automatically renew for the same period (e.g., monthly or annually) at the then-current price, unless you cancel it.
  • Free Trials: We may offer a free trial period. At the end of the free trial, your subscription will automatically convert to a paid subscription at the price displayed to you at the time of purchase, unless you cancel before the trial period ends.
  • Cancellation: You must cancel your subscription at least 24 hours before the end of the current billing period or free trial to avoid being charged. You must manage and cancel your subscriptions directly through your Apple App Store or Google Play Store account settings.
  • Price Changes: We reserve the right to change subscription prices. We will provide you with reasonable notice of any price changes.
  • No Refunds: Purchases and subscriptions are final and non-refundable, except as required by law or as permitted by the rules of the App Store Providers.

8. User Accounts

Some of our Services may require or allow you to create an account, potentially using services like Firebase Authentication (including email/password, Google Sign-In, etc.).

You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.

9. User-Generated Content (UGC)

Our Services may allow you to create, post, or share content ("UGC").

  • Your Responsibility: You are solely responsible for your UGC. You represent and warrant that you own or have all necessary rights to your UGC and that it does not violate these Terms.
  • License Grant to Us: By creating or sharing UGC, you grant HomieLab a worldwide, perpetual, royalty-free, and sublicensable license to use, reproduce, modify, adapt, publish, and display your UGC in connection with operating and marketing the Services.

10. Third-Party Services (Ads & Analytics)

Our Services are funded by advertising and use third-party analytics.

  • Advertising: We use advertising partners, such as AdMob, to show ads in our apps. These partners may collect information to provide personalized advertising. For more information, please see our Privacy Policy.
  • Analytics: We use services like Firebase (Analytics, Crashlytics) to understand how you use our apps, to fix bugs, and to improve our Services.

11. Our Intellectual Property Rights

Aside from the limited license granted to you in Section 3, HomieLab (and its licensors) owns all rights, title, and interest in and to the Services, including all software, code, graphics, text, and trademarks.

12. Disclaimers and Limitation of Liability

  • Disclaimer of Warranties: Our Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee that the Services will be uninterrupted, error-free, or secure.
  • Limitation of Liability: To the fullest extent permitted by law, HomieLab will not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Services.

13. Termination

  • By You: You may stop using our Services at any time.
  • By Us: We reserve the right to suspend or terminate your license and access to the Services, at our sole discretion, at any time and without notice, including if we believe you have violated these Terms.
  • Effect of Termination: Upon termination, your right to use the Services ceases.

14. Governing Law

These Terms are governed by English law, without regard to its conflict of law provisions. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on our website or within the App. By continuing to use the Services after the changes take effect, you agree to the revised Terms.
